Service Description

Georgia Pest Control provides professional pest management services to residential and commercial customers throughout the State of Georgia. Our services include, but are not limited to, inspection, identification, treatment, and monitoring of various pests including termites, rodents, insects, and wildlife. Treatments may involve chemical applications, baiting systems, exclusion techniques, trapping, and integrated pest management solutions. Specific service plans, treatment frequencies, and coverage areas are detailed in your individual service agreement. We utilize methods and products approved by the Georgia Department of Agriculture and the Environmental Protection Agency. Service appointments are scheduled during normal business hours, with emergency services available in certain circumstances as specified in your contract. Weather conditions, property accessibility, and other factors beyond our control may affect service timing and method of application.

No Guarantee or Warranty

Georgia Pest Control makes no express or implied guarantees regarding the complete elimination of pests from your property. Pest biology, environmental conditions, neighboring properties, structural deficiencies, and customer cooperation all influence treatment outcomes. While we employ trained technicians and proven methods, we cannot warrant that pests will not return or that reinfestation will not occur. Any warranties specifically stated in your signed service agreement are limited to those exact terms and conditions. We do not guarantee against damage to property, personal injury, or economic loss resulting from pest activity before, during, or after treatment. Our services are not a substitute for proper home maintenance, structural repairs, or sanitation practices required to prevent pest harborage.

User Responsibilities

As a customer, you agree to provide accurate information about your property, existing pest conditions, and any prior treatments. You must ensure safe access to all areas requiring service, including attics, crawl spaces, basements, and exterior perimeters. You are responsible for securing pets, notifying us of any chemical sensitivities or allergies, and following all pre-treatment and post-treatment instructions provided by our technicians. Failure to prepare your property as directed may result in incomplete service or additional charges. You must inform us of any changes to property conditions, new construction, or landscaping modifications that may affect pest activity. Payment is due according to your service agreement terms, and you remain responsible for charges even if you believe service was ineffective. You agree not to interfere with treatment applications, bait stations, or monitoring devices placed by our technicians.

Limitation of Liability

To the fullest extent permitted by law, Georgia Pest Control shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to our services, including but not limited to property damage, loss of profits, personal injury, or emotional distress. Our total liability for any claim shall not exceed the total amount you paid for the specific service giving rise to the claim during the twelve months preceding the incident. We are not responsible for damage to personal property, landscaping, or structures resulting from necessary service access or treatment applications. We are not liable for allergic reactions, chemical sensitivities, or health effects in individuals with pre-existing conditions. This limitation applies regardless of whether the claim is based on contract, negligence, strict liability, or any other legal theory.

Intellectual Property

All content on our website, marketing materials, service documentation, and proprietary treatment protocols are the exclusive property of Georgia Pest Control and are protected by United States copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any materials without our prior written consent. Customer reviews and testimonials submitted to us may be used in our marketing materials with appropriate attribution. Our service marks, logos, and trade names may not be used in any manner likely to cause confusion or disparage our business. Technical information and recommendations provided during service visits are for your personal use only and may not be disclosed to competing pest control providers.

Governing Law

These Terms of Service and any disputes arising from our services shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles. Any legal action or proceeding relating to our services must be brought exclusively in the state or federal courts located in Fulton County, Georgia. You consent to the personal jurisdiction of such courts and waive any objection to venue in these courts. If any provision of these terms is found invalid or unenforceable under Georgia law, the remaining provisions shall continue in full force and effect. These terms constitute the entire agreement between you and Georgia Pest Control regarding your use of our services and supersede all prior agreements, understandings, and representations.

Changes to Terms

Georgia Pest Control reserves the right to modify or update these Terms of Service at any time without prior individual notice. Changes become effective immediately upon posting to our website with an updated effective date. Your continued use of our services after any changes constitutes your acceptance of the revised terms.
